Proposed New OSHA Privacy Rule – What You Need to Know

The Occupational Safety and Health Administration has proposed a new OSHA privacy rule to help protect workers’ identities. However, this new rule would cut out parts of their existing “Improve Tracking of Workplace Injuries and Illnesses” rule, a change that OSHA believes will make the existing policy easier to comply with, and eliminates their electronic submission requirement for Form 300 injury and illness logs.

This proposed OSHA privacy rule has forced changes on the existing record system. Electronic submission of injury and illness logs for OSHA Forms 300 and 301 was due by July 1st, 2018, and while it will be moved to March 2nd for future submissions, OSHA is neither accepting Forms 300 and 301, nor enforcing the deadline. All injury and illness records from the 2017 calendar year must still be submitted through the Form 300A portal on the OSHA website by July 1st, or they will be marked late.
